TERMS AND CONDITIONS
1. User Accounts
Using the user account details supplied, you can access your patient user account and any services that are available to you as a registered patient (holding a valid MRD number) of Kailash HospitalBefore their account becomes active, new patients who opt to self-register through the patient portal or patient mobile application must wait for Kailash Hospital to validate their registration. By signing up, you acknowledge that:
a) You are utilizing your true identity and are not pretending to be someone else.
b) Kailash Hospital may verify and confirm your registration; your patient user account won't be activated until this happens.
c) The personal data entered during the registration procedure is true, correct, up to date, and comprehensive. To make sure your registration data is always accurate and correct, you must periodically review and update it.
d) Your username and password are personal to you, and you promise not to share or reveal them to any other parties, post them online, or have them displayed in public. It is your responsibility to protect the confidentiality of your password and to notify us right away if it is compromised, lost, or stolen.
e) You also acknowledge and agree that, whether or not you are the one conducting the activities, you will be fully liable for anything done on or through the patient portal and/or mobile application using your account. This covers any illegal use of your computer or account, as well as any unauthorized access to it. By using your account without authorization, you hereby release and hold harmless Kailash Hospital from any and all claims and causes of action resulting from or arising out of such unauthorized use.
f) Kailash Hospital maintains the right, at its sole discretion and without prior notice, to refuse or cancel access to any user account.
g) This application is merely a tool that patients of Kailash Hospital can use to schedule appointments, communicate with one another, and access the personal health records that the hospital maintains.
i) All rules, including the Medical Records guidelines, the Indian Contract Act of 1872, the IT Act of 2000, and its Amendments and Rules, shall be applicable as announced by the authorities.
j) By using Kailash Hospital's patient portal and/or mobile application, you consent to receive notifications via SMS, email, or mobile app that are pertinent to your use of the services. There are notification settings where you can disable non-essential notifications.
k) You may only manage your personal health information and the health information of your immediate family members (with proper authorization) and/or communicate with Kailash Hospital's healthcare providers using the services and information included in this application.
l) In cases of medical emergencies or critical care, you should seek out immediate professional medical attention and should not attempt to contact your healthcare provider via the application. The application's services are only intended to enhance your current healthcare options and facilitate better communication between you and your healthcare providers, as determined by them.
m) Because it's an online application, there may be unforeseen network, infrastructure, or security problems. In that scenario, the application won't function until the problem is fixed. For any services you may require in such a situation, please get in touch with Kailash Hospital directly and in person. The Kailash Hospital disclaims all liability for any downtime experienced by this application.
o) Either party may end this agreement at any time. By ceasing to use the application, uninstalling it, and requesting that Kailash Hospital cancel your user account, you may end this agreement. Only your user accounts on Kailash Hospital's mobile and web applications will be deleted after this. It doesn't end or have any bearing on any other discussions or patient-provider arrangements you may have with Kailash Hospital.
a) The application is housed on Kailash Hospital servers and is compliant with the Information Technology Act & Rules, HIPAA, and GDPR. It stores data, including PHI data, communications, and usage data, including but not limited to location, device type, operating system, browser, date and time, and context usage. In accordance with industry standards, all data transmissions and storage are encrypted.
b) No matter whether you have access to it or not, Kailash Hospital owns all patient (user) health data and databases and formats. Kailash Hospital defines how you can use and access your data.
c) Kailash Hospital disclaims all liability regarding the accuracy, integrity, and completeness of the personal health information you enter or authorize to be entered on your behalf.
d) In order to give you the proper medical care, authorized Kailash Hospital healthcare providers will have access to and be able to modify the data in your personal health records.
e) In accordance with legal requirements, your information may be provided to the government and health authorities upon request.
f) To improve healthcare outcomes for Kailash Hospital patients, non-personalized system analysis of non-identifiable patient data may be performed. Individual users' identities will, however, be kept totally anonymous throughout this analysis.
After logging into the application with your authorized user account, you, the patient, and your healthcare providers at Kailash Hospital can both create data in this application. When you use our mobile application and web patient portal, the following information is collected:
a) Personal information: The name and email address you enter during registration constitute personal information. In addition, you have the option to add your phone number, address, and other personally identifiable information to your user account profile. This application does not store any information about payment methods.
(b) Personal Health Information: Data that you enter into your health trackers manually, by syncing with a health monitoring device, or from a third party source that you alone authorize, includes age, gender, known health conditions, medications, allergies, vaccinations, history of surgeries or procedures, goals, and health journal entries. Personal health information is also entered into the Personal Health Record of a patient by authorized employees of Kailash Hospital. In addition, it contains files and medical reports that you decide to add to your health profile.
4. Use of Information
The personal and health information entered into this application by Kailash Hospital patients and healthcare providers will not be shared, disclosed, or shown to anybody else outside of the hospital's authorized staff.By updating the patient health profile, uploading medical reports, adding review notes, setting health goals, and keeping an eye on feedback pertinent to the patients' use of consultation services, they will be able to update the personal health information of their own patients. In the event that Kailash Hospital terminates a patient's user account, that patient will no longer be able to access the personal health information that was stored in the application storage. The hospital has complete authority to do so. Whether or not to share that information with the patient user before termination of the patient user account is the prerogative of Kailash Hospital
Contact Information: As part of the basic operation of the services you may use, such as appointment booking information, alerts related to reviews, and consultations by Kailash Hospital healthcare providers, the services platform will send you communications (email, phone, and other notifications), in accordance with your notification settings. You will need to confirm your phone number and email address when you register. Should you decide to use customer support services, your contact information may also be used for those purposes. Furthermore, we might utilize your contact details to tell you about our services. Should you decide at any point that you would like to stop receiving these kinds of updates or correspondence from us, please adjust the relevant notification settings in your account. Your contact information is not shared with any third-party.
Anonymized data: Kailash Hospital may examine aggregated and anonymized data (i.e., data gathered through the services without identifying any specific patient) in order to assess healthcare outcomes, patterns of healthcare requirements, and the efficiency of various services and content. Information that has been aggregated and anonymized is not regarded as personal data.
It is your responsibility to keep your password and account information private. You agree to notify Kailash Hospital right away of any unauthorized use of your account, and you are accountable for all activities that take place in it. Any loss you might suffer as a result of someone else using your password and user account without authorization is not Kailash Hospital's fault.
5. Disclosure of Information
If we think it's necessary to follow the law, prevent or stop any illegal, unethical, or legally actionable activity, or to safeguard the rights and safety of you, us, or others, we may divulge any information to government or law enforcement authorities.
With your consent, we may divulge your personal information at your request.
However, Kailash Hospital retains the right to remove or deactivate any user's account if it is determined that the user has violated our terms of service.
6. Restriction on basis of age
It is anticipated that all users of Kailash Hospital's mobile app and patient portal will be older than eighteen. It is permissible to give and retain personal information about others, including minors and children, to parents, guardians, and healthcare providers. When a user submits, stores, or provides information on behalf of a minor or someone under guardianship, they are fully responsible for how that information is submitted, used, and transmitted.
7. Changes to this Policy
You therefore agree to hold Kailash Hospital and the concerned doctor/physician harmless from any losses, costs, charges, and expenses, including reasonable attorney fees, that the concerned doctor/physician and Kailash Hospital may incur as a result of (a) misdiagnosis / faulty judgment / interpretation errors / perception errors arising from (i) your failure to provide correct and/or complete clinical information / history about the patient in a timely and clinically appropriate manner; or (ii) your suppression of material facts; or your failure to provide pertinent clinical information about the patient; or (iii) your misinterpretation of the advice / prescription / diagnosis by yourself; or (iv) your failure to follow doctor's advice / prescription; or (b) incorrect or inaccurate cred or (c) using a credit / debit card which is not lawfully owned by you; or (d) if you permit a third party to use your password or other means to access your account.
10. Transmission and Storage Security
All data is kept on the application vendor's servers in a highly secure data center in India. According to industry standards, the necessary precautions are taken to ensure the secure transmission of personal health information before it is sent from your computer or other devices over the Internet. You should be mindful of the potential risks associated with sending information over the Internet, though, as no data transmission can be 100% guaranteed to be secure. There's also a chance that someone could figure out how to get around our security measures. Because of this, even though we work hard to protect your personal information, you transmit personal information to us at your own risk and we are unable to guarantee its security or privacy.
